O R D E R

This petition has been filed transfer the investigation in Crime No.343 of 2018, on the file of the second respondent to the first respondent agency for further investigations and proceed with the same as per law within a time frame fixed by this Court.

Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondents and perused the materials placed on records.

Mr.M.Mohamed Riyaz, learned Additional Public Prosecutor, appearing for the respondents would submit that only because of the pendency of the quash petitions filed the petitioner and other accused in Crl.O.P.Nos.29836 of 2018 & 2658 of 2019, the second respondent could not complete the https://hcservices.ecourts.gov.in/hcservices/

investigation. He further submitted that as of now, the above quash petitions have also been dismissed by this Court filed by the accused 1 and 2.

Taking into consideration the facts and circumstances, this Court is of the view that the transfer of investigation will not serve any purpose. Therefore, this Court is not inclined to transfer the investigation from the file of second respondent.

Accordingly, this Criminal Original Petition stands dismissed. However, the second respondent is directed to complete the investigation within a period of twelve weeks from the date of receipt of a copy of this order and the first respondent is directed to monitor the investigation done by the second respondent.
