2. Offences alleged are under Section 6(4) of the Tamil Nadu Scheduled Commodities (RDCS) Order, 1982 r/w Section 7(1)(a)(ii) of the Essential Commodities Act, 1955 in Crime No.27 of 2017.

3. Heard both sides.

4. Perused averments in the petition and averments in the counter filed by the Investigation Officer.

5. On 15.02.2017, near Kattu Junction Road in Sriperumbudur Taluk in Thiruvallur District, a lorry was intercepted by Inspector of Police, CSCID. It was found carrying 121 bags, each weighing 50 Kgs. They are rice intended for public distribution. Rice bags were seized and petitioner has been arrested.

6. It is stated in the petition for anticipatory bail that lorry stands in his name and he is also a rice owner. It is also stated that petitioner is already involved in one previous case.

7. Learned counsel for the petitioner submitted that petitioner has been falsely implicated in the case and in previous case, he is on bail. He is ready to cooperate with the Investigation Officer and he has fixed place of residence and does not flee away from justice. Learned counsel for the petitioner also submitted that in connection with the case, A1 and A2 were already arrested and they are in custodial bail.

7. Considering all the above factors, I am inclined to grant him anticipatory bail.

8. Ordered as under:- (i) Anticipatory bail granted to the petitioner; (ii) Petitioner shall surrender before the learned Judicial Magistrate No.I, Kancheepuram, within 15 days of receipt of a copy of the order;

(iii) Petitioner shall execute a bond for Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate;

(iv)Petitioner shall appear before the respondent police on every Monday and Friday at 10.30am for a period of three weeks and thereafter, as and when required for interrogation. -sd/- 01/03/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
