ORDER

This writ petition has been filed, challenging the impugned order dated 08.01.2026 passed by the respondent, rejecting the petitioner's application, seeking for transfer of patta in his name for the properties morefully described in the prayer to this writ petition.

2. Under the impugned order, the petitioner's application has been rejected on the ground that the petitioner did not produce the necessary registered documents. The petitioner claims that he had acquired title over the property pursuant to an unregistered Will. He would submit that despite being an unregistered Will, which is legally permissible, the respondent has rejected the petitioner's application dated 27.11.2025, seeking for transfer of patta in his name in the impugned order.

The petitioner has also filed the unregistered Will and other documents along with this writ petition to establish that the petitioner is the rightful owner of the property and is in possession of the same. This Court is not expressing any opinion on the merits of the said documents. However, since the impugned order has been passed by the respondent without granting an opportunity for the petitioner to submit his explanation as to why the documents produced by the petitioner proves the title of the petitioner as well as his possession over the property, this Court is of the considered view that the impugned order has to be quashed since the same has been passed in violation of the principles of natural justice and is a non speaking order with regard to the contentions as raised by the petitioner in this writ petition.

4. The only reason given for rejecting the petitioner's application in the impugned order dated 08.01.2026 is that the petitioner has only submitted unregistered documents. There is no discussion given by the respondent in the impugned order for rejecting the petitioner's documents.

For the foregoing reasons, the impugned order dated 08.01.2026 is hereby quashed and the matter is remanded back to the very same respondent for fresh consideration on merits and in accordance with law. The petitioner shall submit a detailed explanation to the respondent along with supporting documents to substantiate his claim for transfer of patta for the property in his name within a period of two weeks from the date of receipt of a copy. On receipt of the said explanation along with supporting documents, within the stipulated time, the respondent shall pass final orders on merits and in accordance with law after giving due consideration to the explanation submitted by the petitioner and the supporting documents produced by him within a period of twelve weeks thereafter.

6. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
