The petitioner has filed this Criminal Original Petition to transfer the case in CC No.45 of 2009 pending on the file of the learned Judicial Magistrate, Avinashi to any one of the competent Court by setting aside the order dated 12.04.2016 made in Tr.CMP.No.774 of 2015 passed by the learned District and Sessions Judge, Tirupur.

3. When this Court was about to dismiss this petition on merits, the learned counsel for the petitioner sought permission to withdraw this petition and he has also made an endorsement to that effect. In view of the same, this Criminal Original Petition is dismissed as withdrawn. Consequently, connected Miscellaneous Petition is also dismissed.
