Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the respondents to remove the illegal installation of transformer adjoining the petitioner's property bearing No. 4 / 112N, New No. 556, Om Sakthi Vinayagar Koil street Extension, Sri Lakshmi Puram Gandhi Nagar, Vellore - 6 at their cost and consequentially direct the respondents to pay a compensation of Rs. 25,00,000/- towards the said illegal installation of Transformer.

ORDER
This writ petition has been filed seeking for a direction to the respondents to remove the illegal installation of transformer adjoining the petitioner's property bearing No. 4 / 112N, New No. 556, Om Sakthi Vinayagar Koil street Extension, Sri Lakshmi Puram Gandhi Nagar, Vellore - 6 at their cost and consequentially direct the respondents to pay a compensation of Rs. 25,00,000/- towards the said illegal installation of Transformer.
2. It is stated that the property stated above belongs to the petitioner's mother and while she was alive, electric transformer was installed on the southern side of the building. Thereafter, the petitioner's mother was constrained to file a complaint before the Redressal Forum, Vellore and subsequently orders were passed. Aggrieved over the same, she preferred an 2/5
appeal before the Ombudsman in Appeal No.104 of 2015. After conducting enquiry, certain directions were issued. However, being unsatisfied, the petitioner's mother preferred a review application before the Ombudsman, which was also rejected. Since no concrete action was taken to shift the transformer, which caused great hindrance to the said building, after demise of his mother, the petitioner submitted a detailed representation, dated 08.11.2018 to the State Human Rights Commission. Unfortunately, the same also evoked no response, till date. He further stated that it is his mother's last wish to settle the said property in favour of his sister Nalini. However, due to inaction on the part of the respondents, the petitioner has knocked the doors of this Court by way of this writ petition.
3. Heard the submissions made by the learned counsel on either side and perused the materials placed before this Court.
4. Learned counsel for the petitioner submits that transformer was erected in the year 2015, but till date, respondents have not taken any steps to shift the said transformer from the said place. Hence, this Court may issue appropriate directions to shift the transformer from the petitioner's place, within a time frame to be fixed by this Court.
5. However learned Standing Counsel appearing for the respondents has stated that this Court may issue directions to the petitioner to submit a fresh 3/5
representation in the above regard and thereafter, the respondents may also be directed to consider the said representation.

Having regard to the submissions made by the learned counsel on either side, without going into the merits of the case, this Court directs the petitioner to submit a fresh representation, along with a copy of this order to the respondents, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the 1st respondent shall consider the same and pass appropriate orders, on merits and in accordance with law, within a period of four weeks thereafter.
