Respondents Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondents to promote the petitioner to the post of Forester by recruitment by transfer with effect from 15/08/2016 in the light of recommendation made by the 3rd respondent by his proceedings in Na.Ka.No.588/2021/Pa1 dated 22.02.2021 with all consequential benefit within time frame. Even though the petitioner has sought for larger relief in the writ petition, during the course of arguments, learned counsel appearing for the petitioner restricted the relief to consider the representation of the petitioner and pass appropriate orders within the time frame as may be fixed by this Court.

2. According to the petitioner, the petitioner was appointed as Junior Assistant in the respondent department on compassionate ground. The grievance of the petitioner is that there is delay on the part of the respondent in sending the petitioner for Bhavanisagar training resulting in regularisation of the service of the petitioner got delayed. G.O.(D) No.87 was issued by the Environment and Forest (Forest 2-II) Department, dated 18.6.2020 regularising the service of the petitioner with retrospective effect from 1.12.2015. In view of the delay in declaring probation, the petitioner lost his promotional opportunities. Therefore, the petitioner made representation to the third respondent and the third respondent sent a proposal to the second respondent recommending for promotion to the post of Forester with effect from 15.8.2016. Now, the representation is pending before the second respondent for orders.

Considering the limited prayer as sought for by the petitioner, without expressing any opinion on merit, this Court is inclined to direct the second respondent to consider the representation of the petitioner, dated 14.12.2021 and pass appropriate orders on merit and in accordance with law as expeditiously as possible preferably within a period of 12 weeks from the date of receipt of copy of the order.

4. Accordingly, the writ petition stands disposed of with the above directions. No Costs.
