This civil miscellaneous petition has been filed to condone the delay of 417 days in seeking to set aside the abatement caused by the death of the 1st respondent.

2. Today, when the matter is taken up for hearing, learned counsel appearing for the respondents has no objection to allow this petition.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 417 days in seeking to set aside the abatement caused by the death of the 1st respondent is condoned and the petition is ordered as prayed for.
