Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 3rd respondent to consider the representation of the petitioner dated 04.10.2021 for removal of encroachment made in Kaavakarankuttai Pond situated in S.F.No.248 to an extent of 27.65 Acres of Pudukkottai Village, Sendamangalam Taluk, Namakkal District within the stipulated time as that may be fixed by this Hon'able Court.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.N.Umapathi, learned counsel for the petitioner and Mr.C.Kathiravan, learned Special Government Pleader for the respondents 1 to 4.

2. On the last date, we had recorded the statement of learned Special Government Pleader that no encroachment exists in the subject land. The same was based on the report of the Tahsildar dated

12.03.2022.

3. Learned counsel for the petitioner, on instructions, submits that still the bund erected by the respondents 5 and 6 exists and the same has not been removed.

4. We cannot decide the disputed questions of fact. If the encroachment exists on a kuttai land, it is the duty of the State authorities to remove the encroachment. The respondent authorities may conduct a survey preferably within four months from today and depending upon the report of survey, further steps may be undertaken.

5. The writ petition is disposed of. There shall be no order as to costs.
