The petitioner, who was arrested and remanded to judicial custody on 21.09.2022 for the alleged offences punishable under Sections 341, 324, 392 & 506 (ii) of IPC, in Crime No.117 of 2022 on file of the respondent police, seeks bail.
2. The case of the prosecution as per the de-facto complainant is that the accused have waylaid the de-facto complainant and his friend and robbed a one sovereign gold chain from him and the motor cycle belongs to his friend, at knife point. Hence the case.
3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, since he has got some previous cases. He further submitted that the petitioner was not present at the scene of occurrence and he was no way connected with the alleged offence and he is in custody from 21.09.2022. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Therefore, he prays for grant of bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is a notorious criminal having 22 previous cases. He further submitted that as far as this case is concerned, the petitioner along with other accused have robbed one sovereign gold chain and the motor cycle from the de-facto complainant and his friend at knife point. He also stated that gold chain was recovered from the accused, however, he vehemently opposed to grant bail to the petitioner.
5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.
6. Taking into consideration the facts and circumstances of the case, the submissions made by the learned Government Advocate (Crl.Side) and also considering the previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition stands dismissed. 27.02.2023 ham
