C.M.P.No.9368 of 2018 in S.A.No.1262 of 2008 N.SESHASAYEE,J., This Civil Miscellaneous Petition is filed to condone the delay of 430 days in filing the petition to set aside the abatement caused due to the death of the 2nd appellant in the above Second Appeal in S.A.No.1262 of 2008.

2. Heard the learned counsel for the petitioner.

3. Having regard to the submissions made by the learned counsel for the petitioner and also having satisfied with the reasons stated in the affidavit filed in support of the petition, petition is allowed.
