ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3(2)(a), 4(1), 5(1)(a) and 7(1) (a) of ITP Act in Crime No.22 of 2026, Seeks anticipatory bail.

The case of the prosecution is that the petitioner is that the petitioner is ranked A2 in this case, she joined hands with the other accused( A1) rented the house and involved in running brothel business. Based on the secret information, the respondent police conducted search and rescued three victim. A1 in this case was arrested and based on the statement of A1, the role of the A2 was unearthed and added as an accused.

3. The learned counsel for the petitioner would submit that this Court vide order dated 29.01.2026 in Crl.O.P.No.1917 of 2026 had dismissed the anticipatory bail petition filed by the petitioner. He further submitted that subsequent to the dismissal of anticipatory bail petition, co-accused in this case has been granted anticipatory bail by order dated 27.01.2026 in Crl.M.P.No.143 of 2026, by the Principal District and Sessions Court, Kancheepuram. Hence, the learned counsel for the petitioner prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, the co-accused has

already been granted anticipatory bail by the Principal District and Sessions Court, Kancheepuram and the custodial interrogation of the petitioner is not necessary, I am inclined to grant anticipatory bail to the petitioner, subject to the following conditions.

Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on her appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned Judicial Magistrate-1, Kancheepuram on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that: (a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(b) the petitioners shall report before the respondent police, everyday at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation; (c) the petitioner shall not tamper with evidence or witness either during investigation or trial;

(d) the petitioner shall not abscond either during investigation or trial;

(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
