CORAM

THE HONOURABLE Ms. JUSTICE P.T. ASHA CRP.(PD).No.800 of 2025 J.Elangovan ... Petitioner Vs.

Tamilarasi ... Respondent Prayer:- Civil Revision Petition is filed under Article 227 of the Constitution of India to direct the Hon'ble Family Court, Cuddalore to dispose of IA.No.3 of 2022 in GWOP.No.23 of 2019 pending on its file within a time as may be fixed by this Hon'ble Court. For Petitioner : M/s.P.Sam Japa Singh

O R D E R

The above Civil Revision Petition is filed seeking speedy disposal of IA.No.3 of 2022 in GWOP.No.23 of 2023 which is pending on the file of the Family Court, Cuddalore. 1/4

2. The petitioner/father had filed GWOP.No.23 of 2019 for seeking the custody of the minor daughters Mugilarasi and Kohila Arasi.

3. Pending the main GWOP, the petitioner/father had filed IA.No.3 of 2022 seeking to permit the petitioner to put the two daughters in a Boarding School for getting a good quality of education.

4. The petitioner/father would submit that, in the interest of minors, it would be necessary to admit them to a boarding school where they can receive a quality education. The petitioner/father would submit that at present the children are at a tender age and if the children are allowed to live with their mother she would poison their innocent mind. Therefore, he has come forward with IA.No.3 of 2022 and has now come forward with a revision for an early disposal of the said petition.

5. Heard the learned counsel for the petitioner and perused the 2/4

records.

6. A perusal of the records would indicate that this interlocutory application (I.A.No.3 of 2022) has been dismissed for default on 13.08.2024 and to restore the same IA.No.8 of 2024 has been filed by the petitioner which is pending. Therefore, at this juncture, directions cannot be issued for the early disposal of I.A.No.3 of 2022.

7. Accordingly, the Civil Revision Petition stands dismissed. No costs.
