A.No.1045 of 2021 A.No.1045 of 2021 C.V.KARTHIKEYAN J, This application has been filed seeking leave to institute the suit under clause 12 of the Letters Patent.

2. It has been stated in the affidavit that the cause of action for the suit arose in Chennai, when 145 containers of the plaintiff's containers arrived at Chennai Port on 04.05.2020 and on 05.05.2020 and again on 13.05.2020. It had been stated that invoices were raised at Chennai through the Bank at Chennai. It is also stated that the applicant and the second respondent have places of business within the jurisdiction of this Court. The first respondent also carries on business through their agent in Chennai.

3. In view of all the facts, this Court has necessary jurisdiction to examine the issues raised. Since, part of the cause of action had arisen within the jurisdiction of this Court leave to sue is granted. Application is allowed.
