..Respondents Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents to disburse a sum of Rs.5,00,000/- to the petitioner towards accidental death benefit in Life Insurance Policy No.705635151 issued by the first respondent herein on account of the accidental death of the life assured viz., Jayaprakash within the time frame to be fixed by this Court.

ORDER

By consent, the Writ Petition itself is taken up for final disposal.

2. The petitioner would state that her son was a policy holder bearing Policy No. 705635151, which commenced on 21.09.2011 and premium amounts were paid regularly. The son of the petitioner met with a road accident on 04.06.2012 and inspite of best treatment, https://hcservices.ecourts.gov.in/hcservices/

petitioner's son died on 17.09.2012. The first respondent LIC has disbursed a sum of Rs.5,23,500/- in the name of the nominee. The grievance of the petitioner is that since, it is a case of double benefit and therefore, the parents of the deceased are entitled to a further sum of Rs.5,00,000/- towards accident benefit. In this regard, the petitioner has submitted a representation dated 23.08.2014 to the respondents. Since, the petitioner has not been favoured with any response, she came forward to file the present Writ Petition.

3. Heard Mr.C.Munusamy, learned counsel appearing for the petitioner and Mr.A.Panner Selvam, learned Standing Counsel, who accepts notice for the respondents.

4. Though, the petitioner prayed for a larger relief in this Writ Petition, this Court is of the view that it is suffice to direct the respondents to consider and dispose of the representation submitted by the petitioner on 23.08.2014, on merits and in accordance with law, within a stipulated time frame.

5. In the result, this Writ Petition is disposed of, by directing the respondents to consider the representation of the petitioner dated 23.08.2014 and dispose of the same by passing orders, on merits and in accordance with law, as expeditiously as possible, preferably not later than four weeks from the date of receipt of a copy of this order and inform the decision taken to the petitioner. No costs.
