This application is filed to condone the delay of 322 days in preferring the appeal.
Heard Ms.S.Varsha, learned counsel for the petitioner.
Mr.L.Dhamodaran, learned counsel for the second respondent opposes the application on the ground that no sufficient cause is mentioned for condoning the delay.
We have gone through the affidavit filed in support of the application. Even otherwise, the applicant does not stand to gain by the delay. The contention of the second respondent can be considered while dealing the appeal on merits.
For the reasons stated in the affidavit filed in support of the application, the delay in filing the appeal is condoned. The application is allowed and disposed of.
