JAYACHANDRAN CRIMINAL MISCELLANEOUS PETITION No.2844 of 2022 IN CRL OP.2048 of 2022 RAJESH @ RAJESHWARAN [ PETITIONER / ACCUSED-1 ] Vs STATE REP BY [ RESPONDENT / COMPLAINANT ] THE INSPECTOR OF POLICE, CCB, COIMBATORE, CRIME NO.31 OF 2011 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the time limit for a period of two weeks in Crl.O.P No.2048/2022 dated 02.02.2022 to appear before the learned Judicial Magistrate Court No.VII at Coimbatore to surrender himself so as to recall the Non Bailable warrant and pass such or further orders as this Hon`ble Court Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. V.PURUSHOTHAMAN REDDY, Advocate for the Petitioner and of MR.S.SANTHOSH, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- Heard both sides.
2. The petitioner who failed to appear before the trial court on the hearing dates invited NBW from the trial court. Instead of approaching the trial court for recalling the warrant, he has come before this court by way of anticipatory bail.
3. This court also generously entertained that petition and granted anticipatory bail on condition. The petitioner herein has not complied the condition imposed while granting anticipatory bail. Now he has filed a petition for extension of time. On perusing the records, this court finds that the petition was a jumped bail. He https://hcservices.ecourts.gov.in/hcservices/
approached this court only after surety action initiated by the trial court and even thereafter he has not complied the condition after obtaining anticipatory bail citing dengue fever as a reason. He now seeks for extension of time. This court on perusing the records satisfied that the petition for extension of time is devoid of merit. Hence, the same is dismissed. However, it is open to the petitioner herein to approach the trial court and seek for recall of warrant as per Section 70(2) and get redressal.
