a) directing the defendant to pay a sum of Rs.4,00,00,000/- (Rupee Four Crore only) towards exemplary damages;

b) declaring that the Memo of Compromise dated 15.02.2001 had been acted upon by the plaintiff and the defendant so as to give a quietus to all the pending litigations before the Debts Recovery Tribunal-II, Chennai namely O.A No.109 of 2007 and O.A No.434 of 2007. c) declaring that the memo of compromise dated 15.02.2001 is in full and final settlement of all the dues payable by the plaintiff to the defendant in respect of the claims made in O.A No.109 of 2007 and O.A No.434 of 2007 on the file of Debts Recovery Tribunal-II, Chennai. d) to pay costs of the suit.

J U D G M E N T
When this Civil Suit was taken up for hearing today, the learned counsel for the plaintiff submitted that the matter has been settled out of 2/4
Court and the suit may be dismissed as settled out of Court and also made an endorsement to that effect in the Court bundle.
2. In view of the aforesaid submission and endorsement made by the learned counsel for the plaintiff, the Civil Suit is dismissed as settled out of Court.
