The present petition has been filed to modify the condition imposed on the petitioner in Paragraph No.6(b) of the order dated 13.02.2023 passed by this Court in Crl.O.P.No.2100 of 2023 while granting bail.

2. The learned counsel for the petitioner has submitted that the condition imposed on the petitioner is that the petitioner was directed to stay at Kanniyakumari and appeared before the Kanniaykumari Town Police Station daily at 10.30 a.m., for a period of three months. He would further submit that the petitioner is the only bread winner of the family and he is poor daily wage worker and having a newly wedded wife with a breast feeding child and old aged ailing parents. It is very difficult for the petitioner to bear the expenses to stay at Kanniyakumari District for three months. Hence, he seeks modification.

3. Learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioner has not appeared before the Kanniyakumari Town Police Station even for a single day. 1/3

4. Considering the submissions made by the learned Government Advocate (Crl.Side) this court is not inclined to modify the said condition as against the petitioner.

5. Accordingly, this Criminal Miscellaneous Petition is dismissed. However, the petitioner is directed to comply with the earlier order [6(b)] for a period of two months.
