ORDER

Seeking a direction to the first respondent police to do further investigation and file charge sheet in Crime No.159 of 2015 before the Judicial Magistrate No.I, Villupuram District, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. It is seen that three persons were riding a motor cycle on the fateful day and in the road accident, it is stated that the person who was on the wheels died. Based on the complaint given by the pillion rider, a case in Crime No.159 of 2015 was registered https://hcservices.ecourts.gov.in/hcservices/

for offences under Sections 279, 337, 304(A) IPC. Now, the mother of the deceased has come up for reinvestigation on the ground that her son was not riding the motor cycle on that day and that it was driven by the person, who gave the complaint.

4.It is seen that investigation is pending. Therefore, the Investigating Officer is directed to look into this aspect also before filing the final report before the learned Judicial Magistrate No.I, Villupuram District.

5.With the above direction, this Criminal Original Petition is closed.
