The petitioner, who apprehends arrest for the alleged offence under Sections 120(B), r/w 420, 465, 467, 468 & 471 of IPC in Crime No.150 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that one Rajendra Prasad, who is working in the Indian Bank as branch Manager at Vadapalani Branch made a complaint before the respondent Police stating that on 23.01.2022, an inspection was conducted and during the inspection, it was found that the fraud was committed by the accused by showing fake documents, fake godown and availed loan amount. The said loan amount was utilized for irrelevant purpose and capital funds were also transferred to different accounts. By creating fake documents in order to avail loan, the accused persons cheated the bank to the tune of Rs.232 lakhs and interest of Rs.13.2 Lakh. Hence FIR was registered in Crime No.150/2020 for the offences under Sections 120B, 420, 465, 467, 468 and 471 IPC. 3.The learned counsel appearing for the petitioner submitted that the

petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He also submitted that earlier anticipatory bail petition in Crl.O.P.No.29651 of 2022 was dismissed by this Court on 21.12.2022. Hence prays for grant of anticipatory bail. 4.The learned Government Advocate (Crl.Side) would submit that the case is under investigation and the first accused is still absconding and the custodial interrogation of the petitioner is very much necessary in this case. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the submission made by the learned Government Advocate, and there is no change of circumstances, this court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 05.04.2023 rri
