Crime No.344/17 Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the Honourable Principal District Sessions Judge / Special Court, Salem to consider the bail application of the petitioners herein in connection with Crime No.344 of 2017 pending on the file of the respondent, on the very day of their surrender. ORDER

The petitioners, who are accused in Crime No.344 of 2017 for the offences under Sections 147, 148, 294(b), 324 and 506(ii) IPC, Sections 3(1)(r), 3(1)(s), 3(2)(v) of the Scheduled Castes and The Scheduled Tribes (Prevention of Atrocities) Act 1989, Amendment 2015 and Section 3(1) of the Tamil Nadu Public Property (Prvn. of Damage & Loss) Act, 1992, seek a direction to the learned Principal District Sessions Judge / Special Court, Salem, to consider and dispose of their bail application, that will be filed by them under Section 439 of Cr.P.C. on the same day.

2. Heard the learned counsel appearing for the petitioners as well as the learned Government Advocate (Crl. Side).

3. Considering the nature of the prayer sought for and taking note of the fact that the petitioners are prepared to surrender before the learned Principal District Sessions Judge / Special Court, Salem, there shall be a direction to the Principal District Sessions Judge / Special Court, Salem, to consider the bail application to be submitted by the petitioners along with their surrender before that Court, on the same day on merits and pass appropriate orders. The petitioners are directed to give advance notice to the learned Additional Public Prosecutor before the said court. The criminal original petition is ordered accordingly.
