The Criminal Revision Case is preferred against the order dated 16.11.2023 passed in M.P.No.1092 of 2023 in M.C.No.433 of 2022 by the V Additional Family Court, Chennai.

It is seen that the petitioner is wife and the respondent is the husband. The petitioner/wife filed a maintenance case in M.C.No.433 of 2022 seeking maintenance from the petitioner/husband. Pending the above maintenance case, the petitioner/wife filed miscellaneous petition under Section 125(1) of Cr.P.C., read with Section 151 CPC seeking interim maintenance of Rs.10,000/- per month to the petitioner. The learned V Additional Principal Judge, after hearing both the parties vide order dated 16.11.2023, dismissed the petition. Challenging the said order, the petitioner/wife is before this Court. This revision is preferred as against the interlocutory order passed in M.P.No.1092 of 2023 in M.C.No.433 of 2022. The maintenance case itself is summary in nature and as per Section 397(2) Cr.P.C. as against any interlocutory order passed by the Court below, revision would not lie before this Court.
