ORDER

Since no adverse order is passed against the private respondents, notice to them is dispensed with. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed for a direction, directing the respondents 1 and 2 to consider and act upon the petitioners representation dated 12.12.2025 by removing the illegal constructions raised by respondents 3 to 8 on the temple land comprised in Survey No.7/2, Cadastre No.63/5, Patta No.64, and to restore possession of the land measuring an extent of 0.22 cents to Mariamman Temple, Manalipattu Village, Puducherry District

3. It is the case of the petitioner that the petitioner is the Dharmkartha of Mariamman Temple situated at Manalipattu Village, Puducherry District, however, the private respondents have encroached upon the temple property and constructed permanent residential structures, hence, the petitioner has given representation to the respondents on 12.12.2025 which is pending without consideration till date. Hence, this writ petition.

4. The learned Additional Government Pleader submitted that it is a private temple, if at the petitioner is aggrieved over the alleged encroachment, he has to approach the competent civil court. The learned counsel for the petitioner submitted that liberty may be granted to the petitioner to approach the civil suit.

5. Heard the learned counsel for the petitioner and the learned Additional Government Pleader and perused the materials placed on record.
