This matter is being listed under the caption 'for being mentioned' on a request made by the learned counsel for the applicant in both cases. 2.A subpoena was issued by the registry pursuant to the order dated 31.08.2023 passed in A.Nos.1662 and 3486 of 2023. The Arbitrator has also fixed the date for the appearance of the witnesses on 28.09.2023. Since the date of hearing fixed in the subpoena issued by the registrar has got over, there is a necessity for the registry to issue a fresh subpoena. Accordingly, this Court directs the registry to issue a fresh subpoena to the witnesses fixing the date of hearing before the Arbitral Tribunal as 21.10.2023.

3.The Arbitrator is directed to proceed with the arbitration by examining the witnesses, if they have been duly served with the subpoena or with the notice issued by the Arbitral Tribunal.
