C.M.P.No.4565 of 2020 in S.A.S.R.No.18970 of 2020 P.T.ASHA, J., Barring the respondents 4 and 5, notice has been served on the other respondents. As regards respondents 4 and 5 intimation was given. However, they have not claimed the notice. Therefore, there is a deemed service on the respondents 4 and 5. The respondents though served have not entered appearance either in person or through counsel.

2. The petition is filed to condone the delay of 12 days in filing the above Second Appeal. The reason being that the father of the deponent had died on 29.12.2019 and therefore they were unable to approach the counsel. Sufficient reasons have been given for condoning the delay. Accordingly, the delay is condoned. The Registry is directed to number the Second Appeal.
