COMMON PRAYER: Civil Miscellaneous Appeals filed under Section 19 of the Family Courts Act, 1984, to set aside the fair and decretal order dated 05.12.2022 in F.C.O.P.No.184 of 2014 and F.C.O.P.No.72 of 2016 on the file of the Family Court, Salem and consequently allow the F.C.O.P.No.72 of 2016 as prayed for.

JUDGMENT

(Judgment of the Court was delivered by R.SURESH KUMAR,J.) These Civil Miscellaneous Appeals have been directed against the order passed by the Family Court, Salem in F.C.O.P.No.184 of 2014 and F.C.O.P.No.72 of 2016 by order dated 05.12.2022. Page No.1/4

2. In F.C.O.P.No.184 of 2014, the respondent herein had sought for restitution of conjugal rights. In F.C.O.P.No.72 of 2016, the appellant herein had sought for divorce.

3. Both cases were tried and disposed by a common order dated 05.12.2022, whereby the OP filed by the wife was allowed and the OP filed by the husband was dismissed. Therefore, as against the said order passed by the Court below these appeals respectively have been filed.

4. At the instance of the learned counsel appearing for both sides, these matters are taken on Board for recording compromise.

5. Today the parties and the respective counsel on their behalf filed a joint memo of compromise. Several terms of compromise have been mentioned and accordingly, they have compromised with each other on the issues, which have been raised in both these appeals.

6. Both the appellant as well as the respondent also present before this Court and they have stated that they entered into the compromise and Page No.2/4

they have agreed to the terms of the compromise. This has been reiterated by the learned counsel appearing for the parties.

7. In view of the settlement that has been reached, which has been reduced into writing as joint memo of compromise and in terms of the same, we feel that these Civil Miscellaneous Appeals can be disposed of.

8. Accordingly, these two appeals are disposed of in terms of the joint memo of compromise filed by the appellant and the respondent dated 06.02.2024. The copy of the said joint memo of compromise shall form part of this order.
