Order This Civil Revision Petition has been filed, challenging the order dated 13.11.2025 passed by the Principal District Munsif Court, Salem in I.A. No.9 of 2025 in O.S. No.597 of 2018.
2.In an application filed by the petitioners to examine the fourth defendant as a witness, the Trial Court, under the impugned order, has dismissed the said application by giving the following reasons: a)PW1 to PW3 witnesses were examined on the side of the petitioners, who are the plaintiffs in the suit;
b)When the suit is ripe for arguments, I.A. No.9 of 2025 in O.S. No.597 of 2018 was filed by the petitioners;
c)Earlier, when the suit was pending for arguments, the petitioners filed applications to re-open the evidence and recall the witnesses. The said applications were also allowed by the Trial Court; d)Once again, the petitioners/plaintiffs have filed re-open petition and the same was also allowed on 20.01.2025. Now, once again, the present application i.e. I.A. No.9 of 2025 in O.S. No.597 of 2018 has been filed by the petitioners seeking to examine the fourth defendant as a witness; e)The fourth defendant has already filed his written statement in the suit disputing the contentions of the petitioners in the suit. Only at the belated stage, I.A. No.9 of 2025 was filed by the petitioners.
3.This Court does not find any infirmity in the reasons given by the Trial Court for dismissing I.A. No.9 of 2025 in O.S. No.597 of 2018. Apart from that since the petitioners have challenged the election of the office bearers of the first respondent association pertaining to the year 2018, by the passage of time, nothing would survive for adjudication in so far as relief sought for in the plaint is concerned at this stage.
4.For the foregoing reasons, this Court does not find any merit in this civil revision petition. Accordingly, this civil revision petition is dismissed. Consequently, connected CMP is closed.
