Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the first respondent to consider the petitioner representation dated 28.03.2015 and cancel the permission and licence granted to Mrs.P.Prithi/second respondent to run and operate petrol bunk at Gonur West Village adjoining the temples.

By consent, this writ petition is taken up for final disposal.

2. The petitioner claims that he is the Chairman of Shri Agni Mariamman Temple Trust and the trust is vested with the management of the religious and administrative affairs of Pattappan Temple, Periyandichi temple and Agni Mariamman Temple, all situate at Gonur West Village, Mettur Taluk, Salem and all the three temples are placed in the north, middle and south side respectively of Survey Nos.682B/6, 682B/4A and 689/2A. The grievance expressed by the petitioner is that the second respondent was granted permission to put up petrol bunk which is very near to the temple and in that

event, there is likelihood of fire accidents during temple festivals and without taking into consideration this vital aspect, permission was granted to the second respondent to locate the petrol bunk and in this regard, he submitted a representation dated 28.03.2015 to the first respondent and since his representation failed to evoke any kind of response, came forward to file this writ petition.

3. Heard the submissions of Mrs.P.Rajalakshmi, learned Government Advocate, who accepts notice for the first respondent.

4. This Court, taking into consideration the limited scope of prayer sought for by the petitioner, directs the first respondent to consider and dispose of the petitioner's representation dated 28.03.2015, after putting on notice to the second respondent and pass orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner as well as the second respondent.

5. This Writ Petition is disposed of accordingly. No costs.
