PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct respondents to provide police protection to the petitioner to run the flower vending business at Shop No.68, Chitrakulam North Mada Street, Mylapore, Chennai 600 004 under the name and style of Chithira Vinayakar Whole sale and Retail Flower shop in a peaceful manner pursuant to the representation of the petitioner dated 09.08.2017. The petitioner's request for seeking police protection to the petitioner to run the flower vending business at Shop No.68, Chitrakulam North Mada Street, Mylapore, Chennai 600 004 under the name and style of Chithira Vinayakar Whole sale and Retail Flower shop in a peaceful manner pursuant to the representation of the petitioner dated 09.08.2017.
2. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor appearing on behalf of the respondents. 3.The petitioner has the benefit of an interim order restraining the defendants, their men agents, servants or any other person or persons claiming through them from in any manner interferring with the petitioner's peaceful running of the business in the suit property. In this background, the petitioner has given a complaint/representation on 09.08.2017 to the first respondent seeking for police protection to run her business. Further, the petitioner's representation seeking for police protection is pending before the first respondent. Hence, I am of the view that the ends of justice would be met, if the second respondent is directed to provide protection in order to aid and enforce the interim order obtained by the petitioner.
4. In view of the above, there shall be a direction to the second respondent to provide protection to the petitioner to enable the enforcement of the interim order obtained by her in I.A.No.10345 of 2017 in O.S.No.4108 of 2017 on the file of IV Assistant Judge, City Civil Court at Chennai.
