Writ Petition filed Directing the 4th respondent to take steps to remove the encroachment on the Periyasamy Temple Land situated in S.No.466/39, APalapatti Village, Senthamangalam Taluk, Namakkal District based on the report filed by 5th respondent in U.Mu. 614/2023 dated 06.10.2023 within a reasonable time frame.

ORDER
(Order of the Court was made by S.M.Subramaniam J.) Writ of mandamus has been issued to direct the 4th respondent to take steps to remove encroachment.
2. The revenue authority, during the course of enquiry found that encroachers preferred a writ petition in W.P.No. 38964 of 2024, and learned Single Judge passed an order on 20.12.2024. Paragraph Nos.6 and 7 reads as follows, "....
6.Considering the limited request of the petitioner for disposing of his representation and as there is no serious objection to the same, a direction is issued to the respondents to grant patta in the name of the petitioner by rectifying the defect in UDR by considering the petitioner's representation dated
10.10.2023. In case of a rejection, a speaking orders shall be passed. The said exercise shall be completed within a period of 8 weeks from the date of receipt of a copy of this order.
7.The Writ Petition is allowed. Consequently, the connected miscellaneous petition is closed. No costs."
3. In view of the writ order, the authorities have to conduct further enquiry, and only after taking further course of action, encroachments are to be identified in order to consider the request made by the writ petitioner.
4. In view of the said position, respondents are directed to consider the representation submitted by the petitioner for removal of encroachment after taking a decision in respect of the enquiry, which is pending in pursuance to the order of the Single Judge dated 20.12.2024 passed in W.P.No. 38964 of 2024. The said exercise is directed to be completed within a period of 12 weeks from the date of receipt of a copy of this order.
