Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, directing the 3rd respondent to measure the land comprised in survey No.42/07, Thirumanur Village, Ariyalur Taluk and rectify the entires in the UDR Patta and Field Map Sketch of the village in view of the representation dated 25.08.2015 For Petitioner : Mr.S.Arivazhagan For Respondents : Mr.Durai Solaimalai Additional Government Pleader.

By consent, the main writ petition is taken up for final disposal.

2. The petitioner claims that he is the absolute owner of the property admeasuring to an extent of 78 cents comprised in Survey No.42/07 situated at Thirumanur Village, Ariyalur Taluk and he has also obtained Patta vide No.286 and is in possession and enjoyment of the same. Petitioner later on came to know that there is a discrepancy with regard to measurement in the UDR Patta obtained by him from the revenue authorities and in this regard, he submitted a representation to the 1st respondent to rectify the error in UDR Patta and the field map sketch and to measure the land and since, he has not been favoured with any response, came forward to file this writ petition.

3. Heard the submissions of Mr.S.Arivazhagan, learned counsel appearing for the petitioners and Mr.Durai Solaimalai, learned Additional Government Pleader, who accepts notice for the respondents and he would submit that the representation has been https://hcservices.ecourts.gov.in/hcservices/

given directly to the 1st respondent and no acknowledgment is also available and competent person to entertain such petition shall be Tahsildar, Ariyalur and the petitioner has to make necessary application along with the prescribed fees and since he has failed to do so, this writ petition cannot be ordered.

This Court, taking into consideration the rival submissions, permits the petitioner to submit a fresh representation to the jurisdictional Tahsildar, along with the prescribed fees for rectification of the error in the measurement found in UDR Patta and field map sketch, within a period of two weeks from the date of receipt of a copy of this order and the jurisdictional Tahsildar, on receipt of the same is directed to consider the same and pass orders on merits and in accordance with law, as expeditiously as possible, within a period of two weeks, thereafter and inform the decision taken to the petitioners.

6. The writ petition is disposed of, accordingly. No costs.
