Prayer:- Petition filed under Section 482 of the Criminal Procedure Code, praying to direct the respondent to register the First Information Report against the accused persons based on the petitioner's complaint dated 24.11.2017 as per law. O R D E R

This petition has been filed seeking for a direction, directing the respondent to register the First Information Report against the accused persons based on the petitioner's complaint dated 24.11.2017.

2. When the case is called today, no one is representing for the petitioner.

3. Mr.R.Ravichandran, learned Government Advocate (Crl.Side) appearing for the respondent would submit that pursuant to the complaint given by the petitioner the respondent police enquired the matter and the person, against whom the said complaint was given by the petitioner, has given a written commitment on 25.11.2017, that he would vacate the house belongs to the petitioner and hand over the same to the petitioner and during this period, he would not raise any quarrel with the petitioner.

4. Having recorded the said statement given by the person, against whom the complaint was given by the petitioner, the same was informed to the petitioner. Responding to the same, https://hcservices.ecourts.gov.in/hcservices/

the petitioner had given a written letter to the respondent police that no further action need to be taken on the complaint given by him.

5. Though the petitioner has given such a written request on 25.11.2017 that, since the matter has already been settled, no further action need to be taken and the said letter has also been produced before this Court, on what basis this criminal original petition has been filed by the petitioner, with aforesaid prayers on 02.01.2018, is not known.

6. At any rate, the petitioner himself has given a letter that no action need to be taken on his complaint, nothing survives in this criminal original petition for adjudication.
