This application has been filed by the 1st defendant to condone the delay of 2 days in filing the written statement in the present suit.

2. The learned Counsel for the 1st respondent/plaintiff would submit that he has no objection if this application is allowed.

3. Since, the delay is only 2 days and the reasons stated in the accompanying affidavit are satisfied and the Counsel for the 1st respondent/plaintiff has also no objection, this application is allowed. The delay of 2 days in filing the written statement is condoned.

4. Registry is directed take the written statement on record, if it is otherwise in order and place it on record.

5. Since, the other defendants viz., defendants 2 and 3 have not filed the written statements, they are set ex-parte.

6. List the matter on 27.04.2022.
