Respondents Prayer:- The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the first respondent to dispose of the representation of the petitioner dated 9.1.2020, in the light of the above G.O.Ms.No.560, dated 3.8.1977 as well as Government letter No.86/Q1/2010 dated 4.5.2010 in terms of the orders made in W.P.No.1368 of 2016 dated 21.11.2019.

O R D E R

According to the petitioner, the petitioner preferred an appeal before the first respondent to consider his request for appointment to the post of Junior Assistant from the date of his initial appointment in the light of G.O.Ms.No.560, dated 3.8.1977 as well as Government letter No.86/Q1/ 1/4

2010 dated 4.5.2010 and in terms of the orders passed by this Court in W.P.No.1368 of 2016 dated 21.11.2019. In view of the pendency of the appeal before the first respondent, the writ petition was dismissed by this Court. However, this Court observed that the Additional Chief Secretary/ Commissioner, Revenue Administration shall pass appropriate orders in the appeal preferred by the writ petitioner, without being influenced by the orders passed in the aforesaid writ petition. However, no order has been passed by the respondents. Hence, the petitioner has filed the instant writ petition before this Court for the aforesaid prayer.

2. The learned Additional Government Pleader appearing for the respondents on instructions would submit that pursuant to the said representation, the representation was forwarded to the District Collector and the District Collector also enquired and report has been submitted to the first respondent.

3. In view of the submission made by the learned Additional Government Pleader appearing for the respondents, this Court is inclined to direct the first respondent to consider the representation of the petitioner, dated 9.1.2020 and pass appropriate orders on merit and in accordance with law, as expeditiously as possible preferably within a period of 12 weeks from the date of receipt of copy of this order. 2/4

4. Accordingly, the writ petition stands disposed off with the above directions. No Costs.
