Respondent Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, directing the respondent to issue patta to the petitioner in respect of the property bearing Door No.3, Gopalakrishna Street, Gnanamurthi Nagar, Manambedu Village, Ambattur, Chennai - 53, having an extent of 1448 1⁄2 sq.ft., in old Survey No.102/1, New Survey No.102/3, present Survey No.102/3B, Manambedu Village.

By consent, the main writ petition is taken up for final disposal.

The petitioner claims ownership of the land admeasuring to an extent of 2069sq.feet in Old Survey No.102/1, New Survey No.102/3, present Survey No.102/3B, Manambedu Village, by means of a registered Sale Deed dated 06.11.1991, registered as Document No.130 of 1992 in Sub Registrar Office, Ambattur and after purchase, she had put up a superstructure bearing Door No.3, Gopalakrishnan Street, Gnanamurthy Nagar, Manambedu Village, Ambattur, Chennai - 53. Petitioner would further submit that she made an application on 03.03.2014 for transfer of patta in her name and it was also acknowledged on 10.03.2014 and since no orders came to be passed on the said application, she came forward to file this writ petition.

3. Heard the submissions of Mr.S.S.Swaminathan, learned counsel appearing for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader, who accepts notice for the respondent.

Though, the petitioner has prayed for a larger relief, in the facts and circumstances of this case, this Court is of the view that it would be suffice to direct the respondent to consider and dispose of the application dated 03.03.2014, submitted by the petitioner for transfer of patta in her name, on merits and in accordance with law, within a stipulated time frame.

5. In the result, this Court, without going into the merits of the said application, directs the respondent to consider the application dated 03.03.2014, submitted by the petitioner for transfer of patta in her name, on merits and in accordance with law, and pass orders as expeditiously as possible and not later than four weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner.
