ORDER
The above petition is filed by the wife seeking transfer of G.W.O.P.No.249 of 2021, filed by the husband seeking guardianship for his minor son on the file of the Family Court, Namakkal to the file of the Family Court, Salem to be tried along with H.M.O.P.No.431 of 2019, filed by the wife for dissolution of their marriage.
2. The petitioner wife would submit that she is residing at Salem with her parents along with her minor son. The petitioner would state that she is depending on her parents for their day to day expenses. It is the case of the petitioner that she has to travel 70 Kms to attend the hearing at the Family Court, Namakkal. Therefore, she has come forward with the above Transfer Petition.
3. Heard the learned counsel and perused the records.
4. Considering the fact that sufficient reasons have been given and also taking into account the fact that the minor child is residing with his mother at Salem it is the Court at Salem https://hcservices.ecourts.gov.in/hcservices/
that has the Jurisdiction to try the GWOP. Therefore, the Transfer Civil Miscellaneous Petition is allowed. Accordingly, G.W.O.P.No.249 of 2021 pending on the file of the Family Court, Namakkal is withdrawn and transferred to the file of the Family Court, Salem. Consequently, connected Civil Miscellaneous Petition is closed. No costs.
