JUDGMENT

(Delivered by the Hon'ble Chief Justice) We have heard Mr.D.Rajagopal, learned counsel for the appellant.

2. The appellant has filed the writ petition No.9214 of 2013 seeking directions to the respondent to issue No Objection Certificate in favour of the appellant in respect of his dry lands measuring 19.5 cents. The said writ petition is dismissed.

3. The learned counsel for the appellant submits that under a misconception that even G.O.Ms.No.1208, Housing and Urban Development Department, dated 17.09.1991 was also quashed, the appellant had applied for No Objection Certificate. Subsequently, it is revealed that only G.O. Ms.Nos.1211 and 1212 were quashed and not G.O.No.1208. According to the learned counsel, the appellant be given liberty to challenge the G.O.Ms.No.1208, dated 17.09.1991.

4. It would be too late in the day now to consider the request of the appellant. The appellant earlier filed W.P.No.2506 of 2010 against the rejection of application to re-convey the land. The said writ petition was dismissed. It is observed that the possession was handed over to the respondent pursuant to the land acquisition and the layout is also prepared and as per the layout, the land acquired is earmarked as park area.

In light of the above, we do not find any error committed by the learned Single Judge. The writ appeal as such is dismissed. There will be no order as to costs. Consequently, C.M.P.No.5820 of 2021 is closed.
