PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Certiorari, to call for the records pertaining to the transfer order in En.Pa.Ni4/7111/Tha.A.Po.Ka/Tha.Puri/2024 dated 23.01.2025 and relieving order in En.E1/Ki.Mae/Bommidi Kilai/Tha.A.Po.Ka(Salem)/2025 dated 24.01.2025 from Bommidi Branch to Dharmapuri Town Branch passed by the 1st and 2nd respondents, quash the same.

O R D E R

This Writ Petition has been filed in the nature of a Certiorari Mandamus seeking records relating to the order of transfer of the petitioner dated 23.01.2025 and the consequential relieving order dated 24.01.2025 and to quash the same.

2.In the affidavit filed in support of the Writ Petition, it had been stated that the petitioner is working as a Driver at Bommidi Branch of the first respondent, Tamil Nadu State Transport Corporation (Salem) Limited. It is stated that on 19.01.2025, he had been allotted a Bus bearing Registration No.TN29-2765 and was assigned multiple trips 2/6

from Bommidi to various locations. He faced physical discomfort as a result of a prior accident. Thereafter, he was instructed to take a special trip from Salem to Hosur. Due to the injuries sustained in the prior accident, he declined to undertake the trip. It is stated that on 21.01.2025, a Charge Memo dated 20.01.2025 was issued for that particular incident. The petitioner had also given an explanation. But however, it is contended that the first respondent had transferred the petitioner from Bommidi to Dharmapuri and he has been relieved from Bommidi Branch. 3.The learned counsel for the petitioner states that the petitioner was previously transferred on 25.09.2024 from the Bommidi Branch to the Arur Branch. Upon his request, he was transferred back from the Arur Branch to the Bommidi Branch. It is further stated that he has now been transferred again, this time from the Bommidi Branch to the Dharmapuri Branch.

4.It is contended on behalf of the respondents that the distance between Bommidi and Dharmapuri is just 26 kms only and therefore, the transfer would not cause any major difficulty. 3/6

5.The petitioner, as a Driver, must be prepared to drive a Government Bus at any location. The authority of the respondents to transfer cannot be interfered with by this Court, as orders of this nature are passed on administrative grounds. The Court cannot determine whether the transfer of an individual is right or wrong and therefore, I am not inclined to interfere with the order passed by the respondents. 6.The Writ Petition stands dismissed.
