ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.12.2025 for the offences under Sections 194 of BNSS and altered into 103(1) of BNS in Crime No.1128 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioners herein arrayed as A2 and A3. It is alleged that the petitioners herein along with A1 kidnapped the deceased to a graveyard and attacked him indiscriminately. A2 and A3 kicked the deceased on the chest and A1 strangulated the deceased which resulted in causing death of the deceased. Hence the case. 3.The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they are in judicial custody from 15.12.2025. He further submitted that the petitioners are ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, prays to grant bail to the petitioners.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and submitted that due to previous enmity the petitioners/A2 and A3 kicked the deceased on the chest and A1 strangulated the deceased which resulted in causing death of the deceased. Hence, he opposed to grant bail to the petitioners.

5.Considering the submissions made by the learned counsel appearing on either side; the grievous nature of offence; the specific over tact attributed by the petitioners; this Court is not inclined to grant bail to the petitioners.
