The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 5(i),5(j)(ii) and Section 6 of POCSO Act 2012 in Crime No.01 of 2024, seeks anticipatory bail.

2. The learned Government Advocate stated that the petitioner had committed penetrative sexual assault on the victim girl who is aged about 15 years. He further stated that the petitioner has committed sexual assault on the victim girl many times, due to which she had become pregnant and foetus was aborted. He also stated that investigation will have to proceed with regard to DNA.

3. A perusal of the statement recorded under Section 164 of Cr.P.C of the victim child very clearly shows that she had reiterated the statements in the complaint.

4. Considering the nature of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Hence, this Criminal Original Petition stands dismissed. 05.03.2024 smn 2/3
