Respondents PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to pass orders on the maintainability of the Approval Petitions in Na.Ka.Nos.1017, 1062, 1063, 1068/2014, 9,10,11,24 to 31, 84,85,127 to 130, 158 & 162/2015 which were filed by the second respondent under Section 33[2][b] of the I.D. Act.

Petitioners are the employees of the second respondent. Petitioners raised an issue of maintainability before the first respondent on the Approval Petitions filed by the second respondent.

2.Learned counsel appearing for the petitioners submitted that though the arguments have been heard at length, no orders have been passed on the maintainability of the Approval Petitions.

3.Considering the above submissions, this Court is of the view that it would be appropriate to direct the first respondent to dispose of the Approval Petitions themselves in Na.Ka.Nos.1017, 1062, 1063, 1068/2014, 9,10,11,24 to 31, 84,85,127 to 130, 158 & 162/2015 filed by the second respondent under Section 33[2][b] of the Industrial Disputes Act, 1947. Accordingly, the first respondent is directed to dispose of the Approval Petitions filed by the second respondent, within a period of six weeks from the date of receipt of a copy of this order. It is made clear that while disposing of the Approval Petitions, the contentions raised by the petitioners, both on merits and on the maintainability, will have to be considered and dealt with by the first respondent.

4.Accordingly, the Writ Petition stands disposed of. No costs.
