Registry may put up the counter affidavit said to have been filed in the Original Petition on behalf of the respondent on 11.07.2024 for consideration of this Court.
2. List the matter before the learned Master for recording of evidence on 14.10.2024.
3. Application No. 1931 of 2024 has been filed seeking permission to the applicant to have interim custody of the minor child till the disposal of the petitioner.
4. An interim arrangement had been made on 28.06.2024 by this Court that the applicant /petitioner /father may go over to the residence of the respondent and spend some quality time with the child and also incidentally with the respondent, if it is possible, on every Sunday between 11.00 a.m. and 2.00 p.m. This was by order dated 28.06.2024 and this schedule was put in place till 25.07.2024.
5. A representation has been made by both the learned counsels that this arrangement is on-going and it could be extended until further orders. Further request is made on behalf of the applicant /father that the father may also take the child out in that particular time period to any mall or park or museum, or any other place of common interest.
6. The learned counsel on behalf of the respondent stated that if such place is intimated in advance, the respondent would be able to take the child to that particular place, where the applicant /petitioner /father can interact with the child and permission is also sought that the respondent must also be present in the close vicinity of that place.
7. Permission is granted to both the petitioner and the respondent to exercise their rights to access the child in that particular time on every Sundays. After about 3 week ends in this manner there could be a break for one week end and again this arrangement can continue in the same manner for the next three weeks.
8. Recording the above, giving liberty to both parties to move a fresh application if modification is required of this arrangement, Application No. 1931 of 2024 is closed.
