P.V.Narasimiaya v. The District Collector

G.CHANDRASEKHARAN.,J., This petition is filed for directing the respondents to grant permission to conduct the Erudhuvidum Thiruvizha (manjuvirattu), during Mariamman Koil festival in Pattaguruparapalli Village, Sembarasanapalli Post Sulugiri Taluk, Krishnagiri District scheduled on 24.02.2023 or on subsequent dates.

2. This court on 23.02.2023 had directed the 2nd & 3rd respondent to consider petitioner's representation dated 27.01.2023 and pass suitable orders on the basis of the Circular Memorandum in Rc.007301/Gen.I(1)/2019, dated 09.04.2019 issued by the Director General of Police, Tamil Nadu, Chennai.

3. This matter is listed today under the caption 'for being mentioned' on the basis of the request made by the learned counsel for the petitioner.

4. When the matter is taken up today, learned counsel for the petitioner submitted that petitioner's representation was rejected by the Inspector of Police, Sulagiri Police Station in his proceedings Na.Ka.No.26/D5PS/KGI/2023 dated 06.03.2023 stating that the Circular

Memorandum in Rc.007301/Gen.I(1)/2019, dated 09.04.2019 issued by the Director General of Police, Tamil Nadu, Chennai, applies only to cultural program and not for Erudhuvidum Thiruvizha, for the reason that only district administration has to give permission for organizing Erudhuvidum Thiruvizha.

4. In the said circumstances, paragraph No.5 of order dated 23.02.2023 made in W.P.No.5355 of 2023 reads as follows:- "5. In the said circumstances, this Court directs the 1st respondent/District Collector, Krishnagiri District to consider the petitioner's representation dated 27.01.2023 and pass appropriate order in the manner known to law within a period of two weeks from the date of receipt of copy of this order." 13.03.2023 mpl Note: Registry is directed to carry out the necessary corrections in order dated 23.02.2023 made in W.P.No.5355 of 2023 and issue order copy afresh by 14.03.2023.
