CRP No.4162 of 2015 N.ANAND VENKATESH, J.

This Court passed the final order in the Civil Revision Petition on 12.12.2022 and allowed the Civil Revision Petition. Thereafter, a mention was made on the side of the 1st respondent/plaintiff and the matter was posted under the caption 'For Clarification' today.

2.During the course of hearing, it was brought to the notice of this Court that the original plaintiff viz., Susheela Bai died during the pendency of the suit in the year 2015 and her son M.R.Murali was impleaded in her place. Thereafter, the said M.R.Murali also died and M.R.Krishnakumari, who is the daughter of Susheela Bai has filed an application before the trial Court to substitute herself as plaintiff and the same is pending.

3.The learned counsel for the petitioner submitted that he was not aware about the demise of the plaintiff in this case and hence, no steps were taken to implead the legal heirs of the deceased Susheela Bai. https://www.mhc.tn.gov.in/judis

ssr 4.In view of the above, the order passed by this Court on 12.12.2022 is hereby recalled and the Civil Revision Petition is restored. The necessary application shall be filed to implead the legal heir of the deceased 1st respondent/plaintiff and the affidavit filed in support of the application shall provide all the particulars to enable this Court to deal with the impleading application.

5.Post this Civil Revision Petition under the caption 'For passing further orders' next week. In the meantime, the impleading application shall be filed and brought up for hearing.
