Prayer: Criminal Appeal under Section 482 of the Criminal Procedure Code to direct the first respondent police to further direct to transfer the investigation to CBCID and expedite the investigation and find the real culprits in Crime No.54 of 2013 pending on the file of the 3rd respondent police. It is submitted by the learned counsel appearing for the accused in Cr.54/2013 on the file of the Inspector of Police, (Land Grabbing), District Crime Branch, Kancheepuram and that in respect of the above Crime No, the final report was filed by the Inspector of Police stating that the case has been referred as https://hcservices.ecourts.gov.in/hcservices/

mistake of fact. The final report is dated 14.05.2014 and the petitioner was served with the copy of the final report and they also filed protest petition before the learned Judicial Magistrate No.II, Chengalpattu in Crl.M.P.No.1674/2014 (Protest Petition) and the same was dismissed by the learned Judicial Magistrate No.II, Chengalpet. He also submitted that the petitioner/defacto complainant also filed Crl.R.C.No.1109/2014 and the same is pending.

3. Considering the submission of the learned Additional Public Prosecutor and having regard to the fact that the case has been referred to mistake of fact by the appellant and protest petition was dismissed and criminal revision is pending, the petition is closed for the time being and it is open to the petitioner or police official to take further action on the basis of the orders to be passed in CRL.RC.No.1109 of 2014 consequently the Miscellaneous Petition No. 1/15 is closed.
