ORDER

(Order of the Court was made by C.V.Karthikeyan J.) The matter stands listed today since it had been mentioned that while disposing Civil Miscellaneous Appeal No.1310 of 2018, a Division Bench of this Court, by its judgment dated 05.04.2019, though noted about the filing of

the Cross Objection, had not, specifically, decided the Cross Objection on merits.

2. We have perused the judgment delivered in C.M.A.No.1310 of 2018. The Division Bench had actually found an infirmity in the order of the Tribunal, that future prospectus had not been granted. The Division Bench had also noted that allowances should have been deducted from the salary and instead of embarking into the calculation, it had stated that looking into an overall angle, the compensation awarded is just and therefore, did not interfere with the compensation granted. Hence, we are of the view that no further orders are required in the Cross Objection.

3. The learned counsel for the Cross Objector has made an endorsement in the case bundle to the effect that the appellant may be permitted to withdraw the Cross Objection No.9 of 2019.

4. In view of the same, the Cross Objection stands dismissed. The judgment dated 05.04.2019 delivered in C.M.A.No.1310 of 2018 stands confirmed. The compensation amount with accrued interest and cost shall be deposited within six weeks from the date of receipt of a copy of this order. (C.V.K.,J.)
