Sub-Court, Tiruvannamalai in confirming the judgment and decree dated 30.11.2007 passed in O.S. No.163 of 2005 on the file of the Prl. District Munsif Court, Tiruvannamalai.

JUDGMENT

Counsel for the appellants has already reported no instructions and consequently, Registry was directed to print the name of the appellants in the cause list and the appellants' counsel was also directed to file a memo to that effect.

2. Counsel for the appellants has since filed the memo reporting that the appellants have not evinced interest to continue the second appeal, despite notice. The memo is taken on record. Counsel for the respondent is present.

3. In the light of the abovesaid factors, the second appeal is dismissed for non prosecution. No Costs. Consequently, connected miscellaneous petition is closed.
