ORDER : The Court Made the following order :- The petitioner seeks bail for the offences punishable under Sections 294[b], 323 and 302 of IPC.
2. According to the prosecution, the petitioner and the deceased are neighbours and in the course of wordy altercation, the petitioner herein pushed the deceased down, resulting in his death later in the Hospital.
3. The learned counsel appearing for the petitioner would submit that the deceased died due to fall and the petitioner is not responsible for the death. He would further submit that the petitioner had some disputes with his neighbour, namely, the de facto complainant [son of the deceased]. He would also submit that the petitioner has been falsely implicated in this case and he has been in custody since 16.08.2017.
4. The learned Government Advocate [Criminal Side] would submit that the investigation is almost complete and no previous case is pending against the petitioner.
5. I have perused the materials available on record. Having regard to the fact that the petitioner has been in custody since
16.08.2017 and taking note of the fact that there is no previous case against the petitioner, I am inclined to grant bail to the petitioner, subject to the following conditions:-. i) The petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruchengodu; ii) The petitioner shall report before the respondent police daily at 10.30a.m. for a period of two weeks and thereafter, as and when required for interrogation.
