PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the 2nd respondent police to grant adequate police protection for the petitioner and his family members life and limb on the basis of petitioner's representation dated 25.01.2023 within stipulated time and pass orders and thus render justice. O R D E R

The Writ Petition has been filed to direct the 2nd respondent police to grant adequate police protection for the petitioner and his family members life and limb on the basis of petitioner's representation dated 25.01.2023 within stipulated time and pass orders and thus render justice.

2. Learned counsel for the petitioner submitted that one Gunasekaran is residing in the house opposite to the house of the petitioner in Sirumugai Village. Gunesekaran and his family members are causing innumerable harassment to the petitioner and his family members. In this regard, he gave a complaint against them on 24.11.2022 and then on 25.01.2023. Despite the complaint, they not only harassed the petitioner and his family members by throwing waste and using abusive language but also gave a death threat. Therefore, this petition is filed to grant adequate police protection for the petitioner and his family members

3. Learned Government Advocate (Criminal side) submitted that, on the basis of the complaint given by the petitioner, enquiry was conducted and it was revealed that, the complaint given by the petitioner was a motivated complaint and therefore, it was closed.

4. Considered the submissions and perused the records.

5. In the light of the specific complaints of nuisance said to have been committed by Gunesekaran and his family members and that, they used abusive words and made death threat to the petitioner and his family members, this Court directs the petitioner to submit a fresh representation seeking police protection. On such submission of fresh representation, the respondent police is directed to pass suitable orders in accordance with law.

6. Accordingly, this Writ Petition is disposed of, with the above directions. No costs.
