Prayer: Second Appeal is filed under Section 100 of the Code of Civil Procedure against the Judgment and Decree dated 07.03.2011 passed in A.S.No.42 of 2010 on the file of the Principal District Judge 1/5

at Thiruvallur reversing the Judgement and Decree dated 23.11.2009 passed in O.S.No.111 of 2006 on the file of the Subordinate Court, Poonamallee.

JUDGMENT

The parties to the proceedings have entered into a compromise, in and by which they have agreed to peacefully partition the property amongst themselves. Deed of compromise in the Tamil language has been filed into the Court along with sketch signed by all the parties showing the manner of the partition that has been now effected between the parties.

2. As per the compromise the 1st respondent, Kannan gets 900 Sq.ft., on the extreme western end of the property. The middle portion measuring 660 Sq.ft., goes to the 2nd respondent, Thirumalai and the 2/5

eastern extent of 600 Sq.ft., has to be shared by the appellants jointly.

3. The parties have both signed the compromise as well as affixed their respective Left Thumb Impressions. The parties were also present before this Court and have admitted to the compromise and signing of the same. The compromise deed is taken on file and the Second Appeal is decreed in terms of the compromise deed dated 01.01.2023. The Compromise deed shall form part of the decree. No costs.
